1. Platform Description

Constructra AI is a construction operations management platform that provides:

• Subcontractor management and document collection
• Document storage and organization
• Budget tracking and financial oversight
• Invoice creation and management
• Bid management and invitations
• Inspection scheduling and reminders
• Compliance tracking
• Role-based access for Admin, Project Managers, and Accounting teams
• Transactional SMS and email notifications
• AI-powered document processing

2. User Responsibilities

As a user of Constructra AI, you are responsible for:

• Providing accurate and complete registration information.
• Maintaining the security of your account credentials.
• Ensuring the accuracy of information you enter into the platform.
• Obtaining necessary permissions before uploading documents belonging to third parties.
• Obtaining appropriate consent from subcontractors and project participants before providing their phone numbers to the platform for SMS notifications.
• Complying with all applicable laws and regulations related to your construction projects.
• Managing access permissions appropriately for team members within your organization.
• Notifying us immediately of any unauthorized access to your account.

3. Project Ownership

You retain ownership of all project data you enter into the platform, including project details, budgets, timelines, bid information, subcontractor information, inspection records, and financial records. By using our services, you grant us a limited license to store and process your project data solely to provide and improve the services. We do not claim ownership of your project data.

4. Document Ownership

You retain ownership of all documents uploaded to the platform. This includes documents you upload directly and documents uploaded by subcontractors through secure upload links you generate. You are responsible for ensuring you have the right to store and manage these documents. We store documents securely and do not access, share, or use them for any purpose other than providing the platform services.

5. AI Usage Disclaimer

Constructra AI uses artificial intelligence to assist with document classification, data extraction, and content organization. AI-generated results are provided as suggestions and should be reviewed by users for accuracy. We do not guarantee the accuracy of AI-processed information, and users are responsible for verifying AI-generated outputs before relying on them for business decisions.

6. Third-Party Services

Our platform integrates with third-party services to deliver functionality. These include Twilio for SMS delivery, Supabase for data storage and authentication, Cloudflare for security and performance, and OpenAI for AI document processing. Your use of our platform is subject to the terms and policies of these third-party services as applicable.

7. SMS Notifications

Constructra AI only sends transactional SMS. No marketing or promotional SMS messages are sent through the platform.

Construction companies using Constructra AI are responsible for obtaining appropriate consent from subcontractors and project participants before providing their phone numbers to the platform.

Construction companies are solely responsible for collecting, documenting, and maintaining recipient consent before submitting any mobile phone number into Constructra AI.

By using Constructra AI, customers represent and warrant that they have obtained appropriate consent from every recipient before transactional SMS messages are sent.

Constructra AI relies on the customer to provide only recipients who have consented.

SMS messages are sent exclusively for project-related communication and may include:

• Bid invitations
• Secure document upload requests
• Compliance reminders
• Inspection reminders
• Project updates
• Document approval notifications
• Task notifications

8. Acceptable Use

You agree not to use the platform to:

• Violate any applicable law or regulation.
• Upload or share harmful, fraudulent, or unlawful content.
• Send unsolicited, promotional, or marketing messages through the platform.
• Provide phone numbers of individuals who have not consented to receive messages.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Interfere with or disrupt the integrity or performance of the services.
• Reverse engineer, decompile, or extract source code from our platform.

9. Limitation of Liability

The services are provided "as is" and "as available" without warranties of any kind, whether express or implied. To the fullest extent permitted by law, Constructra AI shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of or inability to use the services. Our total liability shall not exceed the amount paid by you in the twelve months preceding the claim.

We are not responsible for delays or failures in SMS delivery caused by carrier networks, recipient device issues, or third-party service outages.

10. Termination

Either party may terminate the agreement at any time. We reserve the right to suspend or terminate your access if you violate these Terms. Upon termination, your right to use the services ceases immediately. Your data will be handled in accordance with our Privacy Policy, including deletion within 90 days unless retention is required by law.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on our website. Continued use of the services after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the platform.
